TERMS & CONDITIONS FOR GUESS THE CELEBRATION CONTEST

1. Reliance Net Call’s "Guess the Celebration” contest (the "Contest") is applicable for existing subscribers of the Reliance Net Call service (the "Service"), and to the New Registrants for the Service who have done the registration for the Service after the launch of the Contest and shall be available from August 1st, 2009 (17:00 Hrs IST) (“Eligible Subscribers”).
2. This Contest is being run by Reliance Communications (U.K) Ltd. and would be available only to the registered users of the Service.
3. Contest Description:
   There will be a logo on the website www.rnetcall.com stating the Daily Contest.
   • On clicking on the Contest logo, the Eligible Subscribers will see the question “guess what will be celebrated on the website day after tomorrow”.
   • The Eligible Subscribers will be displayed three options to select correct answer, the Eligible Subscribers will have click on radio button to select the correct answer and need to click on submit button to submit the correct answer.
   
   The Eligible Subscribers can have to participate in the Contest by following any of the below options:
   • If the Eligible Subscriber is logged in on his/her Account, the Eligible Subscriber will have to click on the Contest logo, click on the radio button to select the correct answer and submit the Answer by clicking on the submit button. The Eligible Subscribers will see the message as “Your answer has been submitted”.
   • If the Eligible Subscribers in not logged in on his/her Account, the Eligible Subscriber will have to click on the Contest logo, click on the radio button to select the correct answer and submit the Answer by clicking on the submit button. After clicking on the submit button, the Eligible Subscriber will be redirected to the login page, upon successful login to his/her Account, the answer selected by him/her will get submitted. The Eligible Subscribers will see the message as “Your answer has been submitted”.
4. All the answers submitted by the Eligible Subscribers will be consolidated at the end of the day. The System will randomly select one Eligible Subscriber as a winner from those Eligible Subscribers who have submitted the correct answer (the “Lucky Winner”). The Lucky Winner will be intimated through an auto generated e-mail alongwith the further process.
5. The Lucky Winner upon recharging their Account by the available recharge denomination (displayed on the website) by visiting website www.rnetcall.com and selecting PC to Phone plan will get additional talk time worth of US Cent 20 (the “Contest benefit”). The additional talk time can be used for making calls using the Service from any part of the world (where the Service is accessible and allowed). The additional talk time will be credited to Eligible Subscriber’s Account immediately after the successful recharge.
6. The Reliance Net Call customer is bound by the terms and conditions of the Reliance Net Call Customer Service Agreement, as amended from time to time, which the customer has agreed to upon registering for the Reliance Net Call Service (the " Reliance Net Call CSA ").
7. The beneficiary hereby understands and gives his/her irrevocable consent for personal information submitted to Reliance Communications (U.K) Ltd. to be used for this specific Contest. Except where prohibited, participation in the Contest constitutes beneficiary's consent to Reliance Communications (U.K) Ltd. and its agents use of beneficiary's name, likeliness, photograph, voice, opinions and/or hometown in any media, worldwide, without further payment or consideration.
8. The benefit shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the benefit(s) and on production of all such documents/ papers as required by Reliance Communications (U.K) Ltd. before accepting the benefit. Any failure on the part of the beneficiary to comply with directions issued by Reliance Communications (U.K) Ltd. for claim of benefit (s) shall entitle Reliance Communications (U.K) Ltd. to forfeit the benefit(s).
9. Reliance Communications (U.K) Ltd. reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify the Contest at its sole discretion as may be required by business requirements or governmental authorities and all such changes shall be binding on the customer.
10. The benefits under the Contest are neither assignable nor transferable under any circumstances. No substitution for the benefits of the Contest will be given, nor exchange or redemption for an equivalent cash amount be provided under any circumstances. This Contest cannot be substituted with any other Contest made by Reliance Communications (U.K) Ltd.
11. This Contest is subject to force maejure circumstances i.e. Act of God or any circumstance beyond the control of Reliance Communications (U.K) Ltd.
12. Reliance Communications (U.K) Ltd. is neither responsible nor guarantees the quality of the goods/services being Contested as benefit nor is liable for any defect or deficiency of goods or services so obtained by the beneficiary under this Contest.
13. All the benefits (s) shall be subject to such other terms and conditions as may be applicable to specific benefit and shall have to be duly complied by the beneficiary.
14. Reliance Communications (U.K) Ltd. shall not be responsible /liable for (a) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilised in the Contest (b) technical failure of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone line or network hardware or software (c) unauthorised human intervention in any part of entry process of the Contest (d) technical or human error which may occur in the administration of the Contest or processing of entries.
15. LIMITATION OF LIABILITY: IN NO EVENT SHALL RELIANCE COMMUNICATIONS (U.K) LTD. BE LIABLE FOR LOST PROFITS OR ANY INCIDENTAL SPECIAL, OR CONSEQUENTIAL DAMAGES (HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO NEGLIGENCE AND WHETHER OR NOT RELIANCE COMMUNICATIONS (U.K) LTD. WAS OR SHOULD HAVE BEEN AWARE OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.OUR LAIBILITY TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCES IS LIMITED AS PER CUSTOMER SERVICE AGREEMENT. The liability of Reliance Communications (U.K) Ltd. in no cases shall be more than the amount of Recharge paid by the Lucky Winner to avail the Contest Benefit.
16. The completion of the call depends upon various things including but not limited to Network Availability, Third Party Network, Network of the Local Service Provider from where the call is initiated, Network of the Service Provider where the call is terminated, Network Availability at the place of calling party and/or Network availability at the place of call receiving party, and so on. Under no circumstances shall Reliance Communications (U.K) Ltd. be held liable for any failure or disruption or disconnection (including early disconnection, pre matured disconnection) of the call, call drop, call not matured, call could not be connected, unable to call the desired destination number, interrupted voice quality, completeness of the call etc. The Prepaid Customers and the Eligible Pay After Use Customers hereby agree to indemnify and save Reliance Communications (U.K) Ltd., its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis), which may arise directly or indirectly (i) from the use of Additional Talk Time, (ii) from the breach of any of the obligations, the terms and conditions of this Agreement or any warranties and representations made to Reliance Communications (U.K) Ltd., by the Customers, (iii) as a result of any claims asserted by third parties relating to the Offer. Reliance Communications (U.K) Ltd. reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the Customers, in which event the Customers shall cooperate with Reliance Communications (U.K) Ltd., in asserting any available defenses.
17. The beneficiary agrees to release and hold harmless Reliance Communications (U.K) Ltd./ Sponsor, administrators and their respective subsidiaries, affiliates, suppliers, distributors, advertising/Contest agencies and, and each of their parent companies and each such company's officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in Contest or receipt or misuse of any benefit.
18. Once the recharge is done and the Contest is availed, the Customer shall not initiate any chargeback for the amount recharged. In case the same is done, all the charges related to it will be exclusively borne by the customer.
19. Reliance Communications (U.K) Ltd. reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Reliance Communications (U.K) Ltd. reasonable control impairs the integrity or proper functioning of the Contest, as determined by RCII in its sole discretion. Reliance Communications (U.K) Ltd. reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsman like or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be violation of Criminal or Civil Law, and should such attempt be made, Reliance Communications (U.K) Ltd. reserves the right to seek damages from such person to the fullest extent permitted by law, Reliance Communications (U.K) Ltd.'s failure to enforce any term of these Official Rules shall not constitute a waiver to that provision.
20. Any dispute relating to the Promotion or the terms and conditions shall be subject to the exclusive jurisdiction of the Courts in London.
